“We”, “our”, “us” and “Your Vista Cay” or “Your Dream Vacation LLC dba Your Vista Cay” will refer to the owner of the property, the property management company and/ or any of it’s employees, consultants, and/or third party vendors that work with the property management company. The “guest” will refer to the person whose name is on the reservation and any persons that are allowed to enter the property with the consent of any guest. The “property” will refer to a property on the resort and/or the property detailed in the reservation. The “Resort” will refer to Vista Cay Resort, Universal Blvd, Florida 32819
Acceptance of Terms & Conditions
Reserving with Your Vista Cay and/or any payments made on a reservation confirms the acceptance of the terms and conditions described herein and shall be binding on all persons occupying the property whether or not such persons have signed this form.
Your Vista Cay property will be available for occupation from 4:00 PM on day of arrival and must be vacated promptly by 10:00 AM on the date of departure. Arrival and/or departure times may be altered with written consent from us and when requested at least 48 hours in advance of the respective arrival and/or departure time. Early arrival and/or late departures are subject to availability and fees may apply.
Under Florida State law, occupancy may not exceed that which is posted for each property and the guest agrees that they are renting the property on a ‘transient’ basis and no permanent residence is planned. Maximum occupancy includes infants and children. Subletting by the guest of a property is strictly prohibited and will result in eviction from the property with no notice or refund. The guest cannot make a reservation on behalf of those who are under 21 years of age unless the guest is occupying the property for the duration of the reservation. If the guest misrepresents their identity or the purpose of their stay, they may be evicted from the property with no notice or refund.
Parties or large gatherings in excess of the property maximum occupancy and/or those that cause excessive noise are not allowed. If guests behave in an anti social manner including but not limited to; causing damage or disturbance or involvement in any illegal activity, they may be evicted from the property with no notice or refund. Our properties are offered on a self-catering basis. We provide a complementary starter kit of toiletries and cleaning products, once these have been used; the guest is responsible for additional products required for the duration of the reservation.
The guest is required to respect the Resort Quiet Time hours between 11pm and 8am. This includes any noise audible beyond the confines of the property.
To guarantee a reservation all of the following conditions apply;
- A deposit of 25% of the reservation total is due or $250 whichever is the greater, to confirm the reservation.
- The guest must be at least 21 years of age and staying on property during the rental period.
- The guest must return a signed rental agreement AND a copy of a valid and legible drivers license OR an official ID OR a passport.
- The balance of the total for the reservation must be received no later than 30 days prior to the arrival date of the reservation.
Failure to make the final payment by the due date – 30 days prior to arrival, may result in the loss of the reservation and deposit
Cancellations & Changes
We highly recommend you have adequate travel insurance in place to cover cancellation. The guest must advise all cancellations in writing and the following policy applies:
- Cancellation more than 30 days prior to the arrival date – all payments fully refunded minus 4% to cover admin / card fees.
- Reservations cancelled less than 30 days prior to the reservation arrival date then the entire amount paid towards that reservation is forfeited with the exception of the final clean fee.
- No shows shall result in forfeiture of all funds paid. If the balance due remains unpaid 30 days prior to the arrival date, then we reserve the right to cancel the reservation and any amount paid towards the reservation will be forfeited.
We do not issue refunds for unused dates during the reservation.
We reserve the right to amend, curtail or terminate any reservation with good reason without compensation or refund.
All specials and promotions are non-refundable and may be moved to another property of the same room type.
In the unlikely event that circumstances necessitate us to change the property confirmed on your reservation, we will seek to relocate your reservation to a property of a similar or superior standard within our available inventory. However, if we are unable to find a suitable relocation, we will refund any monies paid by the guest, without interest, compensation or consequential loss of any kind. We accept no responsibility for any changes in amenities or furnishings
Accidental Damage & Protection
We require a Security Deposit against accidental damage to the property, inventory or equipment for each property reserved in the form of either:-
- The purchase of an Accidental Damage Waiver (ADW) – the ADW is designed to cover unintentional damages to the property interior that occur during the guest occupancy provided they are disclosed to Your Vista Cay prior to check-out. The guest may purchase this policy during the booking process for $45 through the Your Vista Cay website. This policy covers up to $500 for accidental, unintentional or inadvertent damage. Intentional, malicious damage or gross negligence is not covered by the policy.
- A Refundable Security Deposit of $500, held against a major credit card, prior to the guest arrival date and refunded after the guest departure date assuming there are no payments due for services or damages to the property.
The guest agrees to be responsible for losses or damage to the property, inventory or equipment during the occupancy. If any damage does occur during the occupancy the guest is required to report it to Your Vista Cay immediately and prior to departure. Any accidental damages that exceed $500 or are not covered under the ADW or security deposit will be charged to the credit card on file. In the event this payment fails or is declined we shall bill the guest, the guest agrees to pay this amount within 14 days. If payment is not received Your Vista Cay reserves the right to exercise legal remedies to pursue the amount owed by the guest
For the comfort of our guests and by Florida Law, all properties are strictly NONSMOKING. There is a minimum $250 smoking charge plus applicable fees including but not limited to; carpet cleaning, cleaning of soft furnishings and bedding that will occur immediately if evidence is found of smoke or smoking inside the property.
For the comfort of our guests and with deference to allergies, all our properties are Pet Free, the guest is prohibited from bringing pets under any circumstances. The guest will be liable for any pets brought into the property by guests, guests’ visitors or day guests. The guest shall be subject to an additional cleaning and sanitation fee of $250 and may be evicted from the property without notice or refund.
Items Left Behind
Any personal items left by the guest, if found, can be returned should the guest wish. It is the responsibility of the guest to pay a $25 service fee plus packaging/shipping costs for those items. We do not accept responsibility for any items left behind or loss and/or damages to items that may occur during the transportation or shipping process.
Any items left behind that remain unclaimed will be held for 10 days and then donated to charity or disposed of.
Cleaning Maintenance & Pest Control
A mandatory departure cleaning fee is applied to each reservation and is included in the total reservation price. Towels, sheets, linens and all kitchen equipment are inventoried before and after each guest’s stay. Guest will be charged for any damaged or missing items or for stains on carpet, furniture or walls. If the property is left in a condition that would require an excessive cleaning, such as, but not limited to, retail packaging, un-bagged trash, left-over food,..an additional cleaning fee may apply.
Each property is regularly maintained however no reservation refunds shall be made for appliance/mechanical failures or breakdowns. Any failures or breakdowns should be reported to Your Vista Cay immediately or as soon as is practicable. Air conditioning units must not be programmed below 70 degrees as this may cause the outside unit to freeze up, in this instance the guest will be charged for all repairs and damages. If maintenance is required due to intentional misuse by the guest, a fee including call out charges, parts, supply and labor will be charged to the credit card held on file. If the guest requires assistance from Your Vista Cay outside of office hours – 9am-6pm, due to an issue deemed to be the fault of the guest, a service fee may apply. Issues may include but are limited to; the guest locking himself or herself out of the property, a clogged toilet or A/C freeze up.
Florida has a sub-tropical climate and care must be taken with food that is left uncovered. Uncovered food can attract insects very quickly. Added costs for pest control services incurred for lack of care may be passed to you.
Limit of Liability
All properties are privately owned and neither the owners nor Your Vista Cay, accept any responsibility or liability whatsoever for but not limited to: personal injury, accidents, loss or damage to personal effects or vehicles during the stay or after departure, or alterations to the terms of this reservation caused by events beyond our control; this includes but is not limited to: war, civil commotion, flight delays or cancellations, adverse weather conditions, fire or flood.
We reserve the right to enter the premises at any time for whatever reason without prior notification. This includes authorized workers such as maintenance tech, pest control contractors, etc. Any 3rd party persons will be accompanied by manager. We accept no liability for any loss or damages that may result from the legal and reasonable exercising of such rights.
The guest must ensure children are supervised at all times. We do not accept liability for equipment failure in the property. We do not accept liability for lost or stolen personal property. We offer suitable door security plus a safe and advice on secure behavior. Beyond that we make no guarantees or promises of security. The manager may enter the property at any time, without notice, for the purposes of protection or maintenance. Wherever possible the management will provide notice of such entrance. Your Vista Cay and the owner accept no liability for personal loss or injury to the guest during the rental period. The guest must ensure that they have suitable and adequate insurance cover.
Your Vista Cay accepts no liability for the property’s removal from YVC or transfer by owner affecting availability. In such a case YVC will offer a suitable alternative of similar or better quality, subject to availability. In the event that the guest refuses the alternative, then the guest may cancel the booking with a full refund less $50 administration fee. Your Vista Cay accepts no responsibility or liability for any loss, damage or changes to the terms of this booking caused by events beyond their control including, but not limited to; war, flight delays/cancellations, pandemic, transportation difficulties for whatever reasons, fire, flood or any other event beyond their control. The guest is liable to pay all charges relating to the property rental and any damages beyond normal wear and tear that may occur during the occupancy. The guest accepts that any such costs will be charged to the credit card on file.
In the unlikely event of a problem arising during your stay in one of our properties, you should contact us immediately and we will seek to resolve the matter within a reasonable period of time. If the problem has not been reported to us within 24 hours of the problem arising, we cannot accept responsibility.
Captions & Sections Headings
The various captions and section headings contained in these Terms and Conditions are inserted only as a matter of convenience and in no way define, limit, or extend the scope or intent of any of the provisions of these Terms and Conditions.
Our failure to enforce any provision(s) of these Terms and Conditions shall not in any way be construed as a waiver of any such provision(s) as to future violations thereof, nor prevent us from enforcing each and every other provision(s). The waiver by a party of any single remedy shall not constitute a waiver of such party’s right to assert all other legal remedies available to him/her/it under the circumstances. If it is found that the guest(s) breach any of the above policies or is/are involved in any illegal activity according to the laws and regulations of either Florida State and/or the United States government, we reserve the right to bar access to the property by the guest(s) without any compensation or refund of unused nights and may be barred from staying with any Your Vista Cays property in the future.
These Terms and Conditions are governed by and shall be interpreted in accordance with Florida State Law and the parties hereto shall both submit to the jurisdiction of the Florida courts. With respect to its subject matter, these Terms and Conditions and its Exhibits constitute the entire understanding of the parties superseding all prior agreements, understandings, negotiations and discussions between them whether written or oral, and there are no other understandings, representations, warranties or commitments with respect thereto.
