Definitions ‘YVC’ refers to Your Vista Cay property management. We, Our, Us refers to the property owner, YVC and/or it’s employees, consultants, and/or third party vendors who work with the property management company. The Guest will refer to the Lead Person, (whose name the reservation is under) and any others who are invited to enter the property by consent of the guest. The Lead person is responsible for those occupying the unit and culpable for any resultant issues.
General Your property will be available for occupation from 4:00pm on the arrival date and must be vacated promptly by 10:00am on the date of departure. Arrival and/or departure times may be altered by our written consent. Fees may apply for early arrival or late departures.

Our properties are offered on a self-catering basis and although YVC provides a complementary starter kit of toiletries and cleaning products, once these are used, the guest is responsible for any additional items required for the duration of their stay.
By Florida state law, occupancy may not exceed that which is posted for each home. Violation of these rules will result in loss of rent, deposit and eviction. Maximum occupancy includes children of any age. Subletting shall immediately void the rental agreement with no refunds. Parties or large gatherings in excess of their reservation or who might cause excessive noise are not allowed on the resort. We rent only to business travelers, family groups and responsible adults over 21 years of age. Adults cannot rent properties on behalf of underage guests. Groups who misrepresent themselves will be grounds for removal from the property with no refund.

If we deem you likely to cause damage or disturbance or involved in illegal activities we reserve the right to terminate your arrangements with us immediately with no refunds. The guest agrees that they are renting on a ‘transient’ basis and no permanent residence is planned or offered by the manager.

Reservation requirements To guarantee a reservation all of the following conditions must be met: a reservation deposit of 20% of the total room rate before taxes with a minimum of $200 is due; the rental agreement is to be signed by the guest and received by YVC along with a copy of a valid, clear, and legible driver’s license, official ID or passport of the lead person. The lead person must be over 25 years of age and staying on property throughout the rental period.
We also require a Security Deposit against accidental damages for each property reserved in the form of either: the purchase of an Accidental Rental Damage Waiver for $49 (recommended and available through our website when booking) or a refundable security deposit of $400, held prior to your arrival date and refunded after your departure date assuming there are no outstanding balances for services or damages to the property. Any damages should be reported to YVC immediately and prior to check out. This policy covers $3000 accidental or inadvertent damages. Intentional damage or gross negligence is not covered by the policy. The lead person agrees to remain responsible for all loss or damage to the property or inventory during their stay.

Where loss or damage to the Property, the inventory, or equipment exceeds the Security Deposit Protection Plan coverage or the Security Deposit charged to a major credit card, the Company or the Owner will bill the Guest for the shortfall, and the Guest agrees to pay within 14 days. In the event that the Guest fails to pay any such shortfall, the Company reserves the right to exercise any legal remedies to pursue the amount owed from the Guest. Where the Company finds damage or loss to the Property following the Guests departure that, in the view of the Company or Owner, constitutes malicious damage, then this is not covered by the protection plan. The Company reserves the right to notify law enforcement authorities and prosecute, in addition to billing the Guest for the full amount of repair or replacement, and the Guest agrees to pay within 14 days. A full description of the ADW, if purchased, will be included with confirmation.

A cleaning fee of $90 for a condo unit or $95 for a townhouse unit will be applied to each reservation. A 3.5% service fee will be applied to the total amount due for the reservation after taxes and fees. The balance of the total for the reservation must be received no later than 45 days prior to the arrival date of the reservation. A reminder will be emailed. We reserve the right to charge our costs for any payments made with insufficient funds.

Our properties are all individually owned and we strive to offer guests their property of choice. If that property, for any reason, becomes unavailable due to circumstances beyond our control, we will endeavor to offer a similar or superior property.
Methods of payment Payment to Your Vista Cay may be made by cash, cheque, e-check or credit cards in US funds. YVC accepts MasterCard, Visa and Discover Cards. UK payments may be made by UK cheque or BACS and European payments can be made by bank transfer to our UK based account. All other non-US payments are subject to processing fees. To avoid excessive bank fees we suggest using bank drafts drawn on US banks.

Check in Guests will receive directions, gate and property entry codes a week prior to arrival following full payment as described above. Check in is from 4pm. Earlier check-in may be possible if the unit was unoccupied the night prior to arrival. We are pleased to offer a meet and greet check-in service to first time guest at Vista Cay. Returning guests will receive detailed arrival instructions, resort plan and codes with no check-in required. We are based on-site and available should there be any questions or issues on arrival.

Check out Check-out is 10am. It is important that guests respect the check-out time as it takes several hours to clean and prepare the property for the next guest. Door entry codes are not valid after the check out time and we reserve the right to charge an additional fee for late departures. If the unit is not reserved the day of departure, a later check-out may be possible for a fee of $50.

Cancellations All cancellations must be in writing. Minimum cancellation fee of $50. We understand that life sometimes gets int he way and highly recommend travel insurance* to protect your vacation investment if you need to cancel all or part of your trip.
We reserve the right to cancel a reservation where the balance is not paid 30 days before the arrival date. Any amount paid towards the reservation will be forfeited. Where the reservation is cancelled more than 45 days prior to the arrival date, payment will be refunded minus the cancellation fee and any applicable fees. Reservations cancelled between 45-30 days prior to the arrival date will forfeit 50% of the total room rate before taxes and applicable fees. If the reservation is cancelled within 30 days of the arrival date, all monies paid excluding the security deposit will be forfeited. We do not offer refunds for unused dates during the reservation. We reserve the right to amend or terminate any contract without compensation. Web specials are non-refundable.

Travel Protection Insurance* We are proud to offer CSA All Seasons Travel Plan protection insurance. The charge is 7% of the total cost of your rental. A detailed description of the cover will be provided with your confirmation. We can supply a copy of the cover prior to booking by request. The policy is very comprehensive and includes cover for Trip cancellation, Trip interruption, Travel delay, Accidental death and dismemberment and emergency assistance. You may purchase the policy during the booking process or at any time up to payment of final balance.

Smoking All our units are NON-SMOKING. Smoking is only allowed on the balcony or outside the property with doors and windows closed. A minimum $250 cleaning fee will be applied if evidence is found of smoking inside the unit. Any other necessary costs including carpet cleaning, dry cleaning of drapes and comforters will be charged to the guest’s card.
Pets For the comfort of our guests and with deference to allergies, all our properties are pet free. Guests, including visitors and day guests, who bring pets into our non-pet properties will be subject to additional cleaning and sanitation fees of up to $400 and possible eviction from the property without refund.

Quiet time The resort asks that guests respect the quiet time between 11pm and 8am. This includes any noise audible beyond the confines of your property.

Left items Please check your home before leaving. YVC cannot be responsible for items left in properties. If the item is found we will happily pack and ship it to you. The guest will be responsible for packing and shipping costs plus a $20 handling fee. We do not accept responsibility for any loss or damages to items that may occur during the packing, transportation or shipping process. Any unclaimed items will be held for 10 days and then donated to charity or disposed of.

Cleaning & Maintenance All items are inventoried before and after each stay and guests will be charged for any damaged or missing items. If the property is left in a condition that requires a significantly longer time to clean, additional costs may apply. On leaving: Please leave the property generally clean. As Florida is a tropical area it is very important that no food items or spillages attract insects or pests. All food and trash must be bagged in sealed plastic bags and placed in the garbage bench outside the property. Appliances, counters and surfaces should be wiped clean and any dirty dishes should be washed. Doors and windows should be closed/locked and the A/C returned to the arrival setting. If guests require assistance from YVC after 6:00pm and before 9:00am due to an issue that is the fault of the guests, which includes but is not limited to being locked out, clogged toilet, AC freeze up,.. a service fee may apply.

YVC makes every reasonable effort to maintain each property and it’s equipment in good working order and we strive to quickly correct any maintenance issues that might arise but we cannot control the scheduling of outside service contractors. No refunds will be made for appliance or mechanical failures or breakdowns.
A/C units may not be programmed below 73 degrees which may cause the outside unit to freeze up. Guests will be charged for all repairs and damages caused by If maintenance is required due to intentional misuse by the guest, a fee including call out charge, parts, supply and labour will be charged tot he guest. Please report any maintenance issues during office hours. Only emergencies will be death with after hours.

Limitation of liability We accept no responsibility or liability whatsoever for, but not limited to: personal injury, accidents, loss or damage to personal effects or vehicles during the stay or after departure, or alterations to the terms of this booking caused by events beyond our control; this includes but is not limited to: war, civil commotion, flight delays or cancellations, adverse weather conditions, fire or flood. We reserve the right to enter the premises at any time for whatever reason without prior notification and accept no liability for any loss or damages that may result from the legal and reasonable exercising of such rights.
The guest must ensure that children are supervised at all times. We do not accept liability for equipment failure in the property. Failures should be reported as soon as possible to YVC.

We do not accept liability for lost or stolen personal property. We offer suitable door security and a safe and advice on secure behavior. Beyond that we make no guarantees or promises of security. The manager may enter the property at any time, without notice, for the purposes of protection or maintenance. Wherever possible the management will provide notice of such entrance. The manager and the owner accept no liability for personal loss or injury tot he guest during the rental period. The guest must ensure that they have suitable and adequate insurance cover.

The manager accepts no liability for the property’s removal from YVC or transfer by owner affecting availability. In such a case YVC will offer a suitable alternative of similar or better quality, subject tot availability. In the event that the guest refuses the alternative, then the guest may cancel the booking with a full refund less $50 administration fee.
YVC accepts no liability for any loss, damage or changes to the terms of this booking caused by events beyond their control including, but not limited to; war, flight delays/cancellations, transportation difficulties for whatever reasons, fire, flood or any other event beyond their control.

The management is not responsible for any changes in amenities or furnishings made by the owners. Credit card Agreement The guest is liable to pay all charges relating to the property rental and also any damages beyond normal wear and tear that might occur during the rental period. The guest accepts that any such costs will be charged to the card on file and the guest authorizes YVC to charge for such payments.

Our failure to enforce any provision of this contract shall not in any way be construed as a waiver of any such provision as to future violations thereof, nor prevent us from enforcing each and every other provision. The waiver by a party of any single remedy shall not constitute a waiver of such party's right to assert all other legal remedies available to them under the circumstances. If it is found that the guest breaches any of the above policies or is involved in any illegal activity according to the laws and regulations of either Florida State and/or the United States government, we reserve the right to bar access to the property by the guest without any compensation or refund of unused nights and may be barred from staying with any YVC property in the future.

This contract is governed by and shall be interpreted in accordance with Florida State Law and the parties hereto shall both submit to the jurisdiction of the Florida courts. With respect to its subject matter, this Agreement and its Exhibits constitute the entire understanding of the parties superseding all prior agreements, understandings, negotiations and discussions between them whether written or oral, and there are no other understandings, representations, warranties or commitments with respect thereto.

By placing a reservation with YVC you confirm the acceptance of the terms and conditions described herein and they shall be binding on all persons occupying the premises whether or not such persons have signed these terms & conditions.
